1. Agreement to Terms

By accessing and using TryMyLook ("Service," "Platform," "we," "us," or "our"), you accept and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

TryMyLook is an AI-powered virtual try-on platform that allows users to visualize how clothing items would look on them by uploading photographs. The Service uses artificial intelligence and machine learning algorithms to generate visual representations of clothing items on user-provided images.

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 16 years of age to use TryMyLook. By using the Service, you represent and warrant that you meet this age requirement. Users under 18 should use the Service with parental or guardian supervision.

3.2 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate and current
• Maintain the security of your account password
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

4. Acceptable Use Policy

4.1 Permitted Use

You may use TryMyLook solely for lawful, personal, non-commercial purposes to visualize how clothing items would look on you before making purchasing decisions.

4.2 Prohibited Activities

You agree NOT to:

• ❌ Upload photos of other people without their explicit consent
• ❌ Upload images containing nudity, sexually explicit content, or inappropriate material
• ❌ Upload photos of minors (under 16 years of age)
• ❌ Use the Service to create misleading, deceptive, or fraudulent content
• ❌ Use the Service for commercial purposes without our written permission
• ❌ Attempt to reverse engineer, decompile, or extract the AI models or algorithms
• ❌ Use automated systems (bots, scripts, crawlers) to access the Service
• ❌ Interfere with or disrupt the Service's operation or servers
• ❌ Violate any applicable laws, regulations, or third-party rights
• ❌ Upload content containing viruses, malware, or harmful code
• ❌ Impersonate any person or entity or misrepresent your affiliation
• ❌ Harass, abuse, or harm other users

5. User Content and Intellectual Property

5.1 Your Content

You retain all ownership rights to the photos and images you upload to TryMyLook ("User Content"). By uploading User Content, you represent and warrant that:

• You own the rights to the images or have obtained all necessary permissions
• The images do not violate any third-party rights (including privacy, publicity, or intellectual property rights)
• The images comply with these Terms and applicable laws
• If images include other people, you have their explicit consent to upload and process them

5.2 License Grant

By uploading User Content, you grant TryMyLook a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, process, and store your images solely for the purpose of providing the Service to you. This includes:

• Processing images through our AI algorithms to generate virtual try-on results
• Storing images in your account for future reference
• Using anonymized, non-identifiable data to improve our AI models (with your consent)

This license ends when you delete your images or close your account, except for anonymized data used for service improvement.

5.3 Generated Content

AI-generated virtual try-on images created by the Service ("Generated Content") are provided to you for personal use. You may download and use Generated Content for personal, non-commercial purposes. Generated Content includes a TryMyLook watermark indicating it was created using our Service.

5.4 Our Intellectual Property

The Service, including its design, features, functionality, AI algorithms, software, and content (excluding User Content), is owned by Kudzu.ai and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

6. AI Service Limitations and Disclaimers

6.1 Results Are Approximations

The virtual try-on results generated by TryMyLook are AI-powered approximations and visualizations. They should be used as a visual guide only and do not guarantee:

• Exact fit, sizing, or how clothing will actually look when worn
• Precise color representation (colors may vary based on screen settings and actual products)
• Perfect fabric draping, texture, or material appearance
• Accurate representation of all clothing details, patterns, or embellishments

6.2 Quality Variations

Results quality depends on several factors including:

• Photo quality, lighting, and resolution of uploaded images
• Body pose and positioning in the photo
• Clothing item complexity and image quality
• AI model capabilities and limitations

6.3 Third-Party Products

TryMyLook is not affiliated with clothing retailers or manufacturers. We do not sell clothing and are not responsible for product quality, sizing, availability, pricing, or fulfillment. Any purchases you make from third-party retailers are subject to their terms and policies.

7. Privacy and Data Security

Your privacy is important to us. Our collection, use, and protection of your personal information and photos are governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle your data.

• Payment processing will be handled by third-party payment processors
• Fees are non-refundable except as required by law
• We reserve the right to change pricing with notice to users

9. Disclaimers and Warranties

We specifically disclaim any warranties that:

• The Service will meet your requirements or expectations
• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated results will be accurate, complete, or reliable
• Any errors or defects will be corrected
• The Service will be compatible with all devices or browsers

Your use of the Service is at your own risk. We are not responsible for any decisions you make based on the virtual try-on results.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRYMYLOOK, KUDZU.AI, AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from your use or inability to use the Service
• Damages resulting from unauthorized access to your account or content
• Damages resulting from decisions made based on AI-generated results
• Damages resulting from third-party actions or products

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

11. Indemnification

You agree to indemnify, defend, and hold harmless TryMyLook, Kudzu.ai, and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your User Content or infringement of third-party rights
• Your violation of any applicable laws or regulations
• Any disputes between you and other users

12. Service Availability and Modifications

12.1 Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Technical difficulties or system failures
• Circumstances beyond our control (force majeure)

12.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12.3 Beta Service

As a beta service, TryMyLook is under active development. Features may change, be added, or removed as we improve the platform. We appreciate your patience and feedback during this phase.

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Deleting your account through your account settings
• Contacting our support team at support@trymylook.app

Upon account deletion, your User Content will be permanently deleted within 30 days.

13.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms or our Acceptable Use Policy
• Your use of the Service poses security or legal risks
• We are required to do so by law
• We decide to discontinue the Service

13.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We will delete your User Content according to our retention policies
• Provisions that should survive termination (including disclaimers, limitations of liability, and indemnification) will continue to apply

14. Dispute Resolution and Governing Law

14.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@trymylook.app to attempt to resolve any disputes informally. We will work in good faith to resolve the issue.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, except that either party may bring a claim in small claims court if it qualifies.

14.4 Class Action Waiver

You agree that any disputes shall be brought on an individual basis only, and not as a plaintiff or class member in any class, collective, or representative action.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TryMyLook regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or technical failures.

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or Service features. When we make changes:
